Rental agreement in plain language
Your booking is confirmed once we receive your payment. If we’re unable to fulfill your order, we’ll issue a full refund. Your Order Summary shows what you rented, the total rental period and your quoted charges.
Weeks mean the total duration: 1-7 rental days are billed as one week and 8-14 as two. We count calendar-date intervals, so Monday to the following Monday is seven days; ten days is two billed weeks. Self-service bookings are limited to eight weeks; longer periods require a written availability review. Need longer? Request an extension before pickup; availability, price, payment and the updated pickup must be confirmed. Added full weeks follow the per-item tiers in B3, without repricing paid weeks or automatic renewal.
Until a paid extension is confirmed, keep the equipment ready for the existing pickup. Delivery and collection receipts record the actual item counts and any discrepancy; a photograph or estimated order quantity alone does not decide responsibility.
Both addresses must satisfy the 75-mile exact-road service limit. Each booking includes one original delivery and one original pickup; each of those legs includes its first 15 road miles and has the excess-distance price in B4. An agreed additional customer-requested or customer-caused delivery/pickup leg is charged $2 per mile on all billable one-way road distance, including its first 15 miles, using B4’s floor-to-tenth rule. Adding supplies to the original delivery does not add a leg; a separate supplies delivery does. Use removable labels, empty the bins and stack Large and XL separately. Ordinary wear and routine cleaning are included.
HiveBoxx handles support, refunds and claims; partners may contact you about delivery/pickup ETAs. Cleaning, repair or equipment-loss claims need evidence, itemization and the B8 per-item caps. Paying for the rental is not blanket permission for an incident charge. Use hello@hiveboxx.com or 888-615-2699 for a change or claim question. Read B1-B12 for the complete terms.
A new discretionary goodwill offer may make cash payment conditional on every item actually delivered for that booking being either returned and inspected or resolved under an accepted written settlement for identified missing equipment, with all stated settlement conditions met. This does not delay a refund already owed under your agreement, an earlier unconditional promise or applicable law. Any agreed deduction must be itemized for that booking; it is not automatic permission to debit a card. See B9.
B1. Parties and order documents
This Rental Agreement is between HiveBoxx Operations TX LLC, doing business as HiveBoxx ("HiveBoxx," "we" or "us"), and the customer named in the Order Summary ("you"). Our business mailing address is 5900 Balcones Drive, Suite 100, Austin, TX 78731. Contact us at hello@hiveboxx.com or 888-615-2699.
HiveBoxx always handles customer support, refunds and damage claims. For partner-served orders, authorized local fulfillment partners handle cleaning, delivery, pickup and storage of rental equipment. Partners communicate with you about delivery and pickup ETAs, including when you may not have seen Dispatch notifications. We identify the responsible service contact for your order. Using a partner does not change the contracting operator named above or remove our obligations under this Agreement.
The Order Summary identifies your equipment, quantities, supplies, approved delivery and pickup locations, rental period, prices, taxes and separately disclosed charges. This Agreement includes the version of the Cancellation, Rescheduling and Refund Policy provided when you book and any Payment Method Authorization you separately accept. If documents conflict, mandatory law controls. A specifically accepted order amendment changes only the matters it expressly identifies. The Order Summary controls quantities, approved locations, dates and quoted prices; the Cancellation Policy controls cancellation and date changes; the Payment Method Authorization controls the permitted payment process, not whether a debt exists. This Agreement governs remaining rental matters. Website Terms do not expand rental charges or override these specific documents. The Privacy Notice explains data practices and is not authority to charge a card.
You must be at least 18 and legally able to contract. If you order for a business, you confirm that you have authority to bind it. A cardholder paying for another renter must separately authorize payment; the renter remains responsible for custody and return. A business employee does not become a personal guarantor merely by placing an authorized company order.
The Order Summary identifies the renter, any different payer, any booking agent and the authorized delivery and pickup contacts. A booking agent must have authority from the identified renter to accept the rental documents; we must obtain the renter’s acceptance or a reliable record of that authority. Payment by a partner, employer or concierge alone does not make that payer the renter or a guarantor. Any separately proposed guarantee requires its own express agreement. Each order keeps its own accepted terms, balances and amendments.
B2. Reservation, payment and scope of service
The initial order is payable in full through the payment process shown at checkout. Ordinary bookings do not require a security deposit. Your booking is confirmed once we receive your payment. If we’re unable to fulfill your order, we’ll issue a full refund. We send a booking confirmation after verifying payment. A quote, saved selection, checkout redirect or payment-processing screen alone is not proof that payment was received. Any stock sourcing or inventory review is our internal responsibility and does not place a paid booking into a customer-facing pending-approval status. No customer cancellation deduction applies when we cannot fulfill the order.
We provide the reusable moving bins, dollies and supplies listed in your Order Summary. Large-bin bundles contain Large bins only. XL bins and dollies are separately selected; the Order Summary identifies each bin size and physical quantity. Each XL selection is one physical XL bin. No product or add-on is included merely because it appears elsewhere on our website. Unless a separate written service agreement expressly says otherwise, we do not pack, load your moving vehicle, move your household goods, store your property or provide moving labor. You are responsible for choosing suitable quantities and packing/protecting your belongings. Package recommendations are estimates, not guarantees that everything you own will fit.
B3. Rental period and extensions
Your confirmed rental runs between the delivery and pickup dates in the Order Summary. The selected number of weeks means the total rental period, not additional weeks after an included first week. Rental days are the calendar-date interval between those dates in the service market’s local time zone: Monday to the following Monday is seven days. Rental duration is rounded up to full weeks: 1-7 rental days are billed as one week, 8-14 as two weeks, and so on; ten days is two billed weeks. Self-service bookings are limited to eight weeks. A longer rental, including an extension beyond eight total weeks, requires a written availability review and the approved, paid confirmation required below. This is a self-service limit, not an unconditional promise that longer rentals are available. The Order Summary prints the agreed pickup window and local time zone. A later operationally assigned arrival window does not create a new rental duration or alter cancellation deadlines retroactively; a late HiveBoxx driver does not create an extra customer charge.
Additional rental weeks are calculated in sequence from the rental start applicable to each item, using the actual physical quantities in your accepted order. Items delivered with the original order keep the original rental start; bins added later follow the added-bin rule below. In USD, the confirmed prospective HiveBoxx additional-week rates are:
Overall rental week 2: $1.00 per Large bin, $2.00 per physical XL bin and $5.00 per dolly.
Overall rental weeks 3 and 4, each: $1.50 per Large bin, $3.00 per physical XL bin and $5.00 per dolly.
Overall rental week 5 onward, each: $2.00 per Large bin, $4.00 per physical XL bin and $5.00 per dolly.
Extensions are sold in additional full weeks. Add only the newly approved weeks at the rate for each week reached; do not restart week one, apply the ending tier to earlier weeks or reprice already-paid weeks. XL additional-week rates are per physical bin, not per pair. Supplies do not incur an extension rental charge. The Order Summary or accepted extension quote identifies quantities, rates, added rental amount, applicable tax and any separately approved service change. Existing bookings retain their accepted pricing and valid amendments; these prospective rates do not replace an earlier agreement automatically.
Bins added after the original delivery. Added bins keep the existing confirmed pickup date unless a separate extension is approved. Their rental starts on their actual delivery date, with a one-week minimum and partial weeks rounded up to full weeks through the confirmed pickup date, using the calendar-date method above. No rental is charged for the added items before they are delivered. Adding bins does not restart or reprice the rental of items already delivered. Before you approve and pay, the added-bin quote identifies the physical quantities, added-item rental dates and billed weeks, rental charge, applicable tax and any separate delivery charge under B4. Any additional weeks for those added bins follow the published per-item schedule in sequence from their own delivery date. Existing items retain their original week sequence. A later pickup still requires the extension approval, payment and updated confirmation described above.
Request extensions before your scheduled pickup. An extension is not effective until we approve availability, confirm the price, receive required payment and send an updated confirmation. Until then, the existing pickup remains scheduled. Extensions are not a subscription and do not renew automatically. You may not assume equipment is available for an additional period merely because a payment method is saved.
Until that confirmation, you must prepare for the existing pickup. A request, unpaid extension invoice or saved payment method does not itself extend the rental or create an approved extension charge. We record the accepted added weeks, item quantities, price, payment and revised pickup together.
Example: An order has 10 Large bins, 2 physical XL bins and 1 dolly. Extending an approved three-week rental to five total weeks adds week 4 at $26 (10 × $1.50 + 2 × $3 + $5) and week 5 at $33 (10 × $2 + 2 × $4 + $5), totaling $59 in added equipment rental before applicable tax. The original three-week price stays unchanged. This illustrates the rates, not a standard bundle or a promise that an extension is available.
For a voluntary early return of conforming equipment, the reserved rental period is not automatically prorated. This does not limit remedies for defective equipment, our failure to perform or rights that cannot lawfully be excluded.
B4. Delivery, access and authorized handoff
Each delivery and pickup address must be within the 75-mile service limit, measured using the exact road distance from the serving warehouse assigned to that local leg. We check the two addresses separately; billing rounding does not expand service eligibility. For an approved one-way rental between markets, the delivery and pickup legs may have different assigned serving warehouses. The 75-mile limit applies to each local warehouse-to-address distance, not the distance between the two cities.
One-way rentals between markets require a separate reviewed quote and confirmation. Both markets must be able to fulfill the arrangement, and the origin must have stock available for the route. Availability and the quoted one-way price depend on the route, direction and inventory. The accepted Order Summary identifies both serving markets and warehouses, the approved handoff and return arrangements, equipment and rental period, local delivery and pickup charges, any separately quoted one-way charge and applicable tax. The original-leg distance rules below continue to apply; no distance charge is duplicated in a separately quoted one-way charge. Internal inventory reallocation is our responsibility and is not an additional customer service leg or an unapproved charge added after confirmation. A customer-requested change still requires approval of any disclosed price difference.
Each booking includes one original delivery leg and one original pickup leg. Their distance charges are calculated separately. The first 15 road miles on each of those two original legs are included. For billing, floor each leg’s road distance to one decimal place, then charge $2.00 per mile beyond 15 ($0.20 per excess tenth mile). The Order Summary shows each leg’s distance charge and the total; applicable tax is identified separately. Do not use the rounded billing distance to decide whether an address is within the 75-mile service limit.
Example: A road distance of 18.25 miles becomes 18.2 miles for billing. The excess is 3.2 miles, so that leg’s distance charge is $6.40. If both delivery and pickup have that distance, their combined distance charge is $12.80. This is the distance portion only, not the complete rental price.
Additional service legs. A separately requested delivery or pickup, or an additional trip required by a documented customer-side failed handoff, is an additional service leg. Each such leg is priced at $2.00 per mile on all billable road distance, with no included first 15 miles. Measure one way from the assigned servicing location to the relevant approved service address, floor that distance to 0.1 mile, and multiply the result by $2.00. The first billable tenth is charged at $0.20. We do not double that distance as a round trip or add a flat $25 trip fee or minimum charge. This is the agreed mileage-based service price, not a representation of the exact cost of every trip.
Before dispatching an additional leg, we identify its purpose, assigned servicing location, approved service address, billable distance and total price and obtain your agreement. Any applicable tax is separately disclosed. For multiple service addresses or a combined delivery/collection arrangement, the quote identifies the actual additional leg or legs and each charge; no extra return-to-hub movement or duplicate charge is inferred. The 75-mile exact-road eligibility rule remains. Supplies added to the original scheduled delivery incur no additional-leg fee; a separate delivery of more supplies is an additional leg, with the supplies themselves priced separately.
We do not charge an additional-leg fee for our scheduling error, a partner’s failure, arrival outside the agreed window, internal warehouse movements or a trip you did not request or cause. A customer-caused failed pickup must meet the evidence and access/window requirements in B7. We do not recover the same trip twice or automatically debit a saved card.
Additional-leg examples before applicable tax: 5.0 road miles costs $10.00; 18.25 miles is floored to 18.2 and costs $36.40; 30.0 miles costs $60.00. Each example prices one added leg, without the original booking’s free first 15 miles. A supplies order traveling on the original delivery adds no service leg.
Delivery and pickup are doorstep services at the approved accessible location. Drivers do not enter homes, apartments or businesses. Provide accurate addresses, gate and parking instructions and an authorized recipient where required. Keep the route clear and pets secured. Do not direct a driver to an unsafe or unlawful location. A change to either address requires approval of service eligibility, routing and any disclosed price difference before it is effective.
We confirm service windows rather than guaranteeing an exact minute of arrival. If we expect to miss a confirmed window, we will provide a reliable replacement window or a stated next-update time. If a HiveBoxx-caused delivery failure means we cannot provide a reasonably usable alternative for your move, you may choose a refund of the unprovided order without a customer cancellation fee.
An unattended delivery requires your affirmative approval of the particular address and secure placement location. Our record must show the authorized location, delivered counts, time and a relevant photograph. A photograph alone does not override evidence of misdelivery, a wrong count or a defective item. You do not assume custody of equipment that we did not correctly deliver.
At delivery, we record the equipment actually handed over, by size and quantity, its relevant condition, the time and the authorized recipient or placement instructions. Please check the receipt and tell us promptly about a discrepancy. Your acknowledgment records the handoff; it does not waive a hidden defect or make an incorrect count conclusive. We keep relevant equipment-focused photographs and notes rather than treating the ordered quantity as proof of delivery.
B5. Ownership, custody and approved use
Crates and dollies remain the property of HiveBoxx or the equipment owner identified by HiveBoxx. This is a rental, not a rent-to-own transaction. Paying an overdue or replacement claim does not by itself authorize you to keep or sell equipment. If title is to transfer after a settlement, that must be expressly documented in writing.
You are responsible for equipment properly handed to you, your authorized recipient or your expressly approved unattended location until HiveBoxx or its authorized collector physically takes it back, subject to the exclusions in B8. Do not sell, subrent, pledge, permanently alter or remove ownership markings. Do not move equipment outside the approved service arrangement without our approval. Do not release it to an unverified person claiming to collect it; use the contact or tracking details provided for your order to verify the collector.
Tell us promptly if the approved equipment location, recipient or access arrangements change. Relocation outside the accepted service arrangement requires our approval. An agreed loss settlement must explain any continuing return duty, whether ownership changes, and the treatment of later-found equipment and any credit, so the same loss is not recovered twice.
Use crates for ordinary dry, nonhazardous household or office belongings and dollies only for their intended load-handling purpose. Follow the care and safety instructions supplied with the actual equipment. Do not exceed a labeled or supplied load/stack limit. Do not stand on or ride equipment, place people or animals inside crates, block exits, expose equipment to fire or harsh chemicals, or use it for hazardous, contaminated or illegal materials. Do not transport loose liquids or materials likely to stain, contaminate or damage the equipment. Ask before an unusual use.
Use HiveBoxx-supplied labels or removable labels approved by HiveBoxx before use. Avoid permanent or strong-adhesive third-party moving labels, including red FRAGILE stickers that are difficult to remove or leave glue residue. Remove your labels before pickup without damaging the equipment; ask us for guidance if they do not lift off easily. Additional cleaning charges apply only under B8 and B9, based on documented extra work rather than label choice alone.
B6. Inspection, defects and ordinary wear
Please inspect the delivered counts and condition promptly and report a shortage, damaged latch, cracked crate, unsafe wheel or other defect as soon as reasonably practicable, ideally within 24 hours. This reporting request is not a waiver of a latent defect, an incorrect delivery or a nonwaivable claim. Stop using an unsafe item and contact us. We will arrange a reasonable repair, replacement or appropriate refund/adjustment for equipment we supplied that was defective or unusable without your fault.
Ordinary cosmetic scuffing and wear from proper use are included in the rental. You are not charged for pre-existing damage or contamination, a manufacturing defect or our inadequate cleaning or maintenance. We do not promise that a crate is waterproof, impact-proof or suitable for an unverified load. Nothing in this Agreement excuses us from supplying reasonably safe, usable equipment or from obligations that the law does not allow us to waive.
B7. Return and additional time
Have all rented equipment empty, labels and belongings removed, and equipment accessible at the approved pickup location and window. Stack Large and XL bins separately; never nest one size inside the other. Gather the dollies with the other rented equipment. Routine between-rental cleaning, including ordinary dust and ordinary removal of removable labels, is included. Extra work for customer-caused spills, persistent odors or difficult adhesive residue is assessed under B8 and B9. Do not leave equipment outside an authorized return arrangement or unattended at our facility. Partial returns must be counted so you are not billed for items already collected.
At each collection, we provide or send a handoff record showing the physical counts by item type, the collection time and any apparent discrepancy or condition issue. The authorized collector’s physical receipt ends your custody of those items; later unloading, cleaning or warehouse scanning does not extend it. Partial collections are recorded separately, and we investigate differences between delivered and collected counts before treating an item as missing.
If your failure to make equipment available causes retention beyond the confirmed pickup arrangement, additional time is calculated only for equipment still retained. For each calendar day after the confirmed pickup date on which you retain an item because of that failure, the daily holdover rate is the applicable per-item weekly rate for the overall rental week reached under B3, divided by seven. Overall weeks continue from the applicable item's rental start under B3, including the later delivery date for added bins; the daily amount follows the applicable tier rather than applying the highest tier to every day. The order must separately disclose this daily holdover formula and the applicable weekly schedule for your acceptance. An existing booking keeps its accepted pricing and valid amendments. Approved extensions remain additional full weeks under B3; unauthorized holdover is delay compensation and does not grant an extension or permission to retain the equipment. We round the total additional-time amount once to cents and do not charge both an extension and holdover for the same item/time. No customer-caused delay charge applies before the agreed pickup window has expired or for time attributable to our late driver or other failure.
This Agreement imposes no holdover surcharge for a period without a defined, disclosed and accepted applicable per-item rate. This does not extend the rental, authorize retention of equipment or waive charges for an approved full-week extension under B3.
If a documented customer-side condition causes a failed pickup and an additional collection trip is required, that additional pickup leg uses the mileage-based price in B4: $2.00 per mile on the full one-way road distance from the assigned servicing location to the approved pickup address, after flooring to 0.1 mile, without an included first 15 miles. We identify and obtain your agreement to the specific leg and amount before dispatch. The failed attempt must have been consistent with the agreed window and the access instructions you supplied. We will provide the reason and supporting information. No fee is triggered merely by an automated status or a driver’s unsupported conclusion. No flat $25 pickup fee, minimum, doubled round trip or duplicate distance/trip charge is added. No charge applies for our scheduling error, partner failure or arrival outside the agreed window.
A failed-collection record must identify the agreed window, arrival and reasonable contact attempt, the actual access or readiness obstacle and why another trip was needed. A fee or additional-time claim cannot be based on our failure to follow the accepted instructions or on our internal delay. At fourteen calendar days overdue, management must review the count, custody, contact and condition evidence and issue a written return/loss resolution stating the supported determination or agreed return/settlement arrangements and any remaining disputed issues. The review is not an automatic declaration of loss, automatic debt forgiveness or permission for indefinite rental accrual. Any loss settlement must state the treatment of later-found equipment. Holdover and replacement recovery may not overlap for the same loss period, and the B8 stop on additional time once loss or destruction is established remains in force. Any disputed claim continues through B9 and lawful resolution.
If HiveBoxx causes a missed pickup, extra rental time and rescheduling fees attributable to our delay are waived. Continue to keep the equipment reasonably secure while we arrange collection. You are not responsible for a loss to the extent caused by our failure to collect as promised, our instructions or our negligence. Ordinary weather inconvenience does not cancel a rental automatically; unsafe-weather disruption is handled under C8.
B8. Loss, theft, damage and extraordinary cleaning
Subject to applicable law and the exclusions below, you are responsible for loss, theft, damage beyond ordinary wear or extraordinary cleaning attributable to you while equipment is in your custody, even if a third party takes it. This responsibility does not mean a card can be charged without the separate claim notice and payment process in Section B9. Notify us promptly after discovering a loss or incident. For suspected theft, cooperate in making a truthful police report when appropriate and provide an available report/reference number. No police report alone proves your liability, and a missed deadline alone does not make every loss your fault.
You are not responsible for pre-existing damage or contamination, including odors or adhesive residue present at delivery, ordinary wear, an inherent defect, HiveBoxx's or its authorized contractor's acts or omissions, or loss occurring after collection. Where responsibility is shared, we assess only the loss properly attributable to you. An incident report must consider the delivery record, return counts, photographs, instructions and your explanation.
A repairable item's charge is limited to reasonable documented repair cost, capped at the amount applicable to a total loss of that item. A lost or destroyed item's equipment-loss charge is limited to reasonable documented replacement loss, subject to the following maximum per-item amounts accepted with your order: Large HiveBoxx Bin: $39.95; Extra Large HiveBoxx Bin: $49.95; HiveBoxx Universal Dolly: $119.95. Salvage, recoveries, customer payments and insurance recoveries must not produce duplicate recovery. We will explain any amount an insurer or another legally entitled party may pursue rather than collecting the same amount twice ourselves.
Extraordinary cleaning means necessary work beyond the routine between-rental cleaning included in B7. Customer-caused food or liquid spills, persistent odors from contents or spills, and difficult-to-remove adhesive labels or glue residue may require this extra work. Examples include spilled pickle juice and strong-adhesive third-party FRAGILE labels. A charge requires evidence that the condition is attributable to you and that additional cleaning was reasonably necessary. No charge applies for ordinary wear or routine cleaning, or for a condition present at delivery or caused by HiveBoxx or its authorized fulfillment partners.
We may claim only reasonable, documented incremental labor and materials actually required beyond routine cleaning. We will identify the affected equipment, extra work performed, additional labor time and cost, and materials used. Ordinary cleaning and ordinary label removal already included in the rental are excluded from that calculation. There is no flat cleaning fee, minimum cleaning charge or universal $50 cleaning ceiling. Any estimate is reconciled to supported actual cost under B9.
If equipment cannot reasonably be restored for safe, usable rental, a supported equipment-loss claim may be assessed under this section. The combined cleaning/repair/equipment-loss charge for each item cannot exceed its total-loss cap stated above. We will not stack full replacement cost, repair cost and contamination cost for the same item or recover the same cost twice. Applicable tax, if legally due, is identified separately rather than assumed. All extraordinary-cleaning claims follow the itemized notice, dispute and separate payment process in B9.
We do not automatically add lost profits, a penalty multiplier, a damage-handling percentage or indefinite rent after an item is established lost or destroyed. Reasonable additional-time charges stop for that item when its loss or destruction is established; a disputed missing count first requires investigation. Court-awarded remedies remain governed by applicable law, not a unilateral card debit.
B9. Claim notice and payment
Before seeking payment for a loss, theft, damage or extraordinary-cleaning claim, we will provide an itemized notice identifying the order, affected items, evidence, calculation and how to ask questions or dispute an error. For an extraordinary-cleaning claim, the calculation identifies the additional labor time and cost, materials, and the routine work excluded; supporting records may include condition photographs, contemporaneous inspection notes, cleaning records and relevant incident communications. We inspect and send initial discrepancy notice within five business days of collection. We resolve the discrepancy or issue a documented claim determination within ten business days after that notice. A determination is not a customer’s agreement to pay and does not by itself authorize a charge. These targets do not replace an earlier statutory or card-network deadline. We may revise a documented estimate with an explanation and credit any overpayment.
For equipment physically received by HiveBoxx or its authorized collector, the five-business-day return-inspection and initial-discrepancy-notice period starts with that physical receipt. Each partial collection has its own receipt and inspection record; waiting for another item does not restart inspection of equipment already collected. We document counts, relevant condition, any claimed extra work and the basis for attributing it to the customer. Business days mean Monday through Friday, excluding observed United States federal holidays, using the service market’s local time zone. Earlier applicable legal or card-network deadlines control.
For loss, theft, damage or extraordinary cleaning, our standard card process is a separate itemized payment request with your incident-specific approval, using a processor-supported authenticated checkout. A general card-on-file authorization is not advance agreement that every incident is your fault. If a claim is disputed or you decline card payment, we will use a documented resolution, insurance or lawful civil recovery process. A refusal to authorize a card charge does not by itself extinguish a properly established debt or establish theft.
Future discretionary goodwill. A discretionary goodwill concession is an additional benefit we are not already required to provide under the accepted agreement, an existing unconditional promise, applicable law or applicable payment-network requirements. A new written offer must identify the booking, the proposed concession and its conditions before you accept it. We do not release that discretionary cash concession until every item actually delivered under the booking has either been returned and inspected or been resolved under an accepted written settlement for identified missing equipment, and all stated settlement conditions are met. A settlement for one missing item does not release cash while other equipment remains unreturned and unresolved. A complaint or request alone does not create an unconditional refund promise.
Written loss settlement and net amount. A settlement must identify the booking, actual delivered and returned counts, the itemized responsibility and evidence, the gross concession, any documented recoverable loss under B8, and the agreed net result. With your express written agreement, we may apply that concession against a properly established loss for the same booking, subject to the combined per-item caps and all applicable credits. We then refund any agreed excess or issue an itemized invoice for an agreed remaining debt. We do not automatically offset an unrelated booking or account balance. An invoice or an accepted settlement does not, by itself, authorize a card debit. Any payment still follows the separately authorized process in B9.
Cash timing after the conditions are met. Once every delivered item is accounted for through return and inspection or the accepted missing-item settlement, all stated conditions are satisfied and the concession amount is resolved, we initiate any resulting refund to the original payment method within five business days, or earlier if applicable law or card-network rules require. We send confirmation of initiation; your financial institution controls when it posts. The inspection period and refund-initiation period are separate, and an earlier applicable deadline controls both. We do not describe a conditional offer as an immediate refund or delay a deadline by waiting for an internal warehouse status.
Already-owed refunds and disputes. The conditional-goodwill process does not postpone money already owed for cancellation, our failure to fulfill, defective or unprovided service, qualifying supplies, a prior unconditional refund promise or another legal obligation. Those amounts follow the accepted policy and any earlier applicable deadline. You keep your lawful dispute rights, and raising a dispute does not erase a separately established lawful return or payment obligation. We reconcile previous refunds, processor reversals, insurance and recoveries so we do not collect the same amount twice or recharge to bypass a dispute.
Example of an agreed closeout. If we offer a $100 discretionary concession and a written same-booking settlement establishes a documented $39.95 loss for one missing Large bin, the agreed cash balance is $60.05 after the settlement conditions are met. The $39.95 is a ceiling, not an automatic fee: if supported loss is lower, the deduction is lower. The settlement must also address any continuing return duty and later-found equipment. This example creates no automatic card-charge authority.
Equipment care and claim examples
Routine cleaning and ordinary wear do not create a customer claim. A supported $12 repair to one Large bin is a $12 claim, not an automatic $39.95 replacement charge. If necessary, nonduplicated extra cleaning and repair of one XL bin total $55, the combined charge is capped at $49.95 before any legally due tax. If the odor or adhesive residue was present at delivery, it is not charged to you. These examples assume the B8 responsibility and evidence requirements are met and do not authorize an automatic card debit; B9 still applies.
B10. Default, recovery and legal rights
If equipment is not returned or another material breach occurs, we may suspend further rentals, request a replacement payment arrangement and make a documented demand for return. We will give the notice and opportunity to respond required by applicable law. We may seek lawful recovery through voluntary surrender or court process. This Agreement does not authorize forcible entry, entry into an occupied residence without lawful authority, a breach of the peace, seizure of your unrelated property or taking your belongings as collateral.
Where lawful, we may request that you assemble the equipment for an agreed collection at a mutually reasonable location. A documented demand identifies the booking, supported outstanding counts, the proposed return arrangement and a way to correct an error. We consider the evidence and an agreed resolution before escalating a disputed claim. Collection costs or legal fees are not automatically added; any such recovery needs an applicable contractual or legal basis.
We may report objectively supported suspected theft to the proper authorities. Late return, a billing disagreement or failed card payment is not automatically a criminal offense. Police reporting must not be used as a threat to force payment of a disputed civil claim. No provision waives a bankruptcy stay or other legal protection.
B11. Responsibility for belongings and third-party claims
You control packing and the transport of your belongings. HiveBoxx is not selling insurance for those belongings. If you retain a separate mover, its contract and insurance govern its service; that does not release HiveBoxx from responsibility for our own equipment or acts.
To the extent permitted by law, you are responsible for reasonable third-party loss directly caused by your negligent or intentional misuse of the equipment or material breach. You do not indemnify HiveBoxx for HiveBoxx's negligence, defective equipment, willful misconduct or matters the law prohibits shifting to you. A request for indemnification requires notice, evidence and a reasonable opportunity to participate in the defense; no settlement may impose an unapproved obligation on you. There is no automatic debit of legal fees or alleged indemnity costs.
Except where prohibited, neither party seeks speculative, remote or duplicative consequential losses for an ordinary contract breach. This clause does not exclude bodily injury claims, damage caused by negligent or willful conduct, fraud, express promises, statutory consumer remedies or any liability that cannot be restricted. This Agreement does not include a general liability dollar cap, mandatory arbitration clause or jury/class waiver.
B12. Notices, disputes and continuing obligations
Use the order portal when available, hello@hiveboxx.com, or 888-615-2699 for service changes. We will timestamp requests and provide a reference or written confirmation. A portal outage does not remove your ability to give timely notice by another listed channel. A requested change takes effect only when confirmed, but its receipt time, not our later response, determines whether your request was timely.
HiveBoxx handles approvals of refunds, claims, fee changes and settlements. Fulfillment partners coordinate delivery and pickup timing; an operational ETA message does not itself amend the rental price or promise a refund. We record accepted amendments and offers in writing and investigate a reported conflicting instruction or representation. This allocation does not excuse obligations imposed on HiveBoxx by applicable law or the acts of its authorized representatives.
Applicable law governs this Agreement. Any proceeding must be brought in a court with lawful jurisdiction and venue; this clause does not override a consumer's protected forum. Contacting support is encouraged but does not surrender chargeback, regulator, court or other nonwaivable rights. A clause found unenforceable is limited or severed only to the extent lawful. Accrued lawful payment, return and claim-resolution obligations survive completion; new website terms do not retroactively change the order.
